MONTGOMERY, Ala. – Prosecutors may not pursue manslaughter charges after an Alabama into was arrested in the death of her unborn infant, who changed into fatally shot for the duration of a combat. Marshae Jones was arrested on Wednesday after a Jefferson County grand jury indicted her on manslaughter charges, igniting a firestorm throughout the USA. But District Attorney Lynneice Washington’s workplace urged caution in a late Thursday information release, pronouncing the workplace has not yet decided whether or not to pursue the manslaughter charge, lessen it or drop the case altogether.
“Foremost, it must be said that that is a certain tragic case, resulting in the loss of life of an unborn toddler,” the release said. “We experience sympathy for the families involved, consisting of Ms. Jones, who misplaced her unborn baby. The truth that this tragedy became a hundred% avoidable makes this case even extra disheartening.” Jones’ case is peculiar and, a few say, unprecedented. According to al.com, 23-year-old Ebony Jemison was initially charged in December after taking pictures in Pleasant Grove that caused the death of the unborn toddler.
But investigating authorities alleged the pregnant Jones, now not Jemison, initiated and instigated the attack. Jemison informed BuzzFeed News that she fired a gun as a “warning shot” after Jones and a group of friends attacked her over courting trouble. The grand jury declined to deliver expenses towards Jemison, the DA’s office said, determining that she acted in self-defense. The DA’s workplace has no longer yet backed a request for a remark. Efforts to reach Jones and Jemison on Friday have been unsuccessful.
But Jones’ fee appears to contradict a part of Alabama’s Criminal Code. Though the code does include “fetal murder” language, which defines an “unborn child in utero” as a man or woman, no matter viability, the code additionally states that the prosecution of “any girl with appreciate to her unborn child” should not be permitted under criminal murder charges like manslaughter.
